1. Introduction
These Terms of Service ("Terms") govern the use of the HealthReact Application ("Application").
By installing, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you must not install or use the Application.
2. Provider
The Application is provided by:

The Application is part of the HealthReact research platform.
3. Purpose of the Application
The Application is intended to support scientific and healthcare-related research activities.
Depending on the specific research study, the Application may:
- Deliver questionnaires and surveys
- Collect participant responses
- Collect location information where permitted
- Provide study-related notifications and interventions
- Facilitate research data collection and analysis
The Application is not intended to provide medical diagnosis, treatment, or emergency services.
4. Eligibility
You may use the Application only if:
- You are authorized to participate in a study using the Application; or
- You have been granted access by an authorized research institution.
Additional eligibility requirements may apply to specific studies.
5. Research Participation
Participation in research studies is governed by the study-specific documentation provided by the responsible research institution.
The Application serves solely as a technical platform supporting research activities.
Participation in a study may require:
- Informed consent
- Additional agreements
- Study-specific participation requirements
6. User Responsibilities
You agree to:
- Provide accurate information where required
- Use the Application only for its intended purposes
- Comply with all applicable laws and regulations
- Not interfere with the operation, functionality, or security of the Application
- Not attempt to gain unauthorized access to systems, accounts, or data
You are responsible for maintaining the security of your device and credentials.
7. Data Protection
The processing of personal data is governed by the HealthReact Privacy Policy.
In most research projects:
- The research institution acts as the Data Controller
- The Provider acts as a Data Processor on behalf of the research institution
Additional information regarding personal data processing may be provided by the institution conducting the study.
8. Intellectual Property
All intellectual property rights related to the Application, including but not limited to:
- Software
- User interface designs
- Content
- Trademarks
- Documentation
remain the exclusive property of the Provider or its licensors.
No ownership rights are transferred to users.
Users receive a limited, non-exclusive, non-transferable, and revocable right to use the Application solely for authorized purposes.
9. Availability
The Provider makes reasonable efforts to maintain the availability and functionality of the Application.
However, the Application is provided on an "as available" basis.
The Provider does not guarantee uninterrupted operation and may suspend, modify, or discontinue parts of the Application when necessary.
10. No Medical Advice
The Application does not provide medical advice.
Any information presented through the Application must not be relied upon as a substitute for professional medical consultation, diagnosis, or treatment.
In the event of a medical emergency, users should immediately contact appropriate emergency services or qualified healthcare professionals.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Application is provided "as is" and "as available."
The Provider makes no warranties or representations regarding:
- Accuracy or completeness of data
- Continuous or uninterrupted availability
- Fitness for a particular purpose
- Absence of defects, errors, or vulnerabilities
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Provider shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data
- Loss of research results
- Interruption of research activities
- Damages resulting from misuse of the Application
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
13. Suspension and Termination
The Provider may suspend or terminate access to the Application if:
- These Terms are violated
- Access is no longer authorized by the relevant research institution
- The Application or the underlying study is discontinued
Users may discontinue use of the Application at any time.
14. Third-Party Services
The Application may rely on:
- Third-party services
- Operating system components
- Device APIs
- Wearable device integrations
- Cloud infrastructure providers
The Provider is not responsible for the availability, functionality, or performance of such third-party services.
15. Changes to These Terms
The Provider may update these Terms from time to time.
Updated versions will be made available through the Application and/or the HealthReact website.
Continued use of the Application after such updates constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, unless mandatory legal provisions require otherwise.
Any disputes arising from or related to these Terms shall be subject to the jurisdiction of the competent courts of the Czech Republic.
